A relevância do Poder Judiciário como instrumento de efetividade da Lei Maria da Penha para a prevenção e combate da violência doméstica e familiar contra a mulher

Resumo

Diante da criação de mecanismos de combate e prevenção da violência doméstica e familiar contra a mulher pela Lei 11.340/2006, verifica-se a necessidade de especialização da prestação jurisdicional quanto à adoção de medidas de assistência e proteção às mulheres em situação de vulnerabilidade. O magistrado, em especial, sem prejuízo de outros operadores jurídicos ou assistenciais, deve estar atento às questões de gênero partindo da análise do caso concreto e suas especificidades. Daí a importância da designação de uma audiência na fase preventiva, judicializada a partir da representação de medidas protetivas de urgência, ou mesmo da realização da audiência de custódia, a fim de que possa o juiz melhor averiguar a situação e adotar providências que visam a implementação de um sistema organizado e multidisciplinar voltado à prevenção do fenômeno e atendimento integral aos envolvidos, conferindo proteção jurídico-legal, assistencial, social e humana.

Conducting the hearing as a means of improvement and effectiveness of the measures in Maria da Penha Law

Abstract: Before the creation of mechanisms to combat and prevent domestic and family violence against women by Law 11.340/2006, there is the need for specialization of adjudication on the adoption of measures of assistance and protection to women in vulnerable situations. The magistrate, in particular, without prejudice to other legal or assistance operators should be aware of gender issues based on the analysis of the case and its specificities. Hence the importance of the appointment of an audience in the preventive phase, judicialized from the representation of urgent protective measures, or even the day of custody hearing in order to who can best judge to ascertain the situation and adopt measures aimed at implementing an organized and multidisciplinary system aimed at preventing the phenomenon and comprehensive care to those involved, giving juridical-legal, healthcare, social and human protection.
