Resumo

A produção deste artigo científico trata da evolução legislativa e hermenêutica das disposições acerca dos efeitos da citação na execução fiscal. A análise se inicia com breve explanação sobre o instituto da citação, para embasar, posteriormente, a discussão travada em torno de quais os dispositivos aplicáveis na interrupção da prescrição, tendo em vista regulação da matéria pela Lei de Execuções Fiscais, Código de Processo Civil e Código Tributário Nacional, inclusive com a posterior modificação realizada pela LC 118/2005. Desse modo, recentes decisões do Superior Tribunal de Justiça são examinadas para levantar a necessidade de aplicação dos parágrafos 2º a 4º do artigo 219, do CPC. A interpretação conjunta do CTN com o CPC valoriza o devido processo legal e a igualdade, bem como a duração razoável do processo, obrigando a Fazenda Pública a promover a citação do devedor de forma mais célere.

The evolution of interruption of prescription by citation in tax enforcement

Abstract: The production of this scientific article deals with the legislative and hermeneutic evolution of the provisions about the effects of the citation in tax enforcement. The analysis begins with a brief explanation of the citation institute, to support later discussion waged around which provisions are applicable on the interruption of prescription, in view of the regulation of this matter by the Law of Tax Enforcement, Civil Procedure Code and National Tax Code, including the subsequent modifications made by LC 118/2005. Thus, recent decisions of the Superior Court of Justice are examined to raise the need for application of paragraphs 2 to 4 of the article 219, of the Civil Procedure Code. The joint interpretation of Civil Procedure Code with National Tax Code values the due process and equality, as well as the reasonable duration of the process, forcing the Treasury to promote the citation of the debtor more quickly.
