Exagero hermêutico e interpretativo
Resumo
Hermenêutica e interpretação jurídica são conceitos indissociáveis da ideia de entendimento e aplicação de normas num ordenamento jurídico. O intérprete deve sempre ter a cautela e o zelo de observar regramentos básicos de hermenêutica e interpretação, entendendo e respeitando os limites intrínsecos à própria norma em análise. A extrapolação desses limites resultará numa retórica argumentativa que favorece apenas ao intérprete, permitindo a ele fundamentar com peculiar subjetividade, justificando o que se imaginaria injustificável. A efeito, aliado à supervalorização do Poder Judiciário na contemporaneidade, a extrapolação desses limites pelo juiz no momento de decidir resulta no combatido decionismo judicial, onde, com suposto amparo em técnicas de hermenêutica e interpretação jurídica, o magistrado decide na verdade conforme sua consciência e vontade e não dentro dos limites semânticos e parâmetros delineados na própria norma.

Considerations over decisionismo and brazil’s judiciary: exaggeration on hermeneutic and law interpretation
Abstract: Hermeneutic and legal interpretation are indissociable concepts on the idea of understanding and applying legislation. The interpreter must always be cautious and ensure that he observes basic rules of hermeneutic and law interpretation, understanding and respecting the boundaries intrinsic to the rule itself. The extrapolation of those limits will surely result on an argumentative rhetoric that favors only the interpreter himself, allowing him to support his arguments with peculiar subjectivity, only to justify what would be unjustifiable. On that matter, considering the contemporary overvaluation of the Judiciary, that extrapolation by the judge on the moment of his decision result on the hard-fought decisionismo, where allegedly based on hermeneutic techniques and law interpretation the magistrate in fact decides based on his own consciousness e not within the semantic parameters of the law.
