O abandono afetivo paterno-filial, violação do princípio da dignidade humana e a caracterização do dano moral
Resumo
O presente trabalho tem por escopo subsidiar os operadores do Direito nas questões indenizatórias por abandono afetivo paternofilial, uma vez que a ausência dos elementos imateriais, como amor, zelo e dever de cuidado dos pais em relação aos filhos menores podem violar o Princípio da Dignidade Humana. O tema é atual, haja vista que, a todo momento, pululam em nossos Tribunais demandas desta natureza. O estudo contribui diretamente com a ciência do Direito, principalmente no que tange aos ramos do Direito Civil, em especial, ao Direito de Família, ao Direito da Responsabilidade Civil e ao Constitucional. O assunto, apesar de já investigado por parte de estudiosos do Direito, será abordado, nesta ocasião, sob um novo prisma, o afeto como valor jurídico, propondo um novo direcionamento ao entendimento da responsabilidade civil no âmbito da relação paterno-filial, em decorrência do abandono afetivo.

The paternal affective abbandonment, the violation of the human dignity principle and the characterization of moral damage
Abstract: The present work has the purpose to subsidize legal practitioners in indemnity issues for affective paternal-filial abandonment, since the absence of intangibles such as love, care and duty of care of parents toward their minor children may violate the principle of Human Dignity. The topic is current, given that, at all times, swarming in our courts of this nature demands. The study contributes directly to the science of law, especially in regard to the branches of civil law, in particular the Family Law, Constitutional Law and Civil Liability. The subject, despite already investigated by scholars of law, will be addressed on this occasion, in a new light, affection as legal value, proposing a new direction in understanding the liability under the paternal-filial relationship due to emotional abandonment.
