A fixação da competência territorial nos delitos cibernéticos

Resumo

Em tempos de uma sociedade digital, o instituto jurídico padece de atualização, a fim de se adequar às novas realidades. Atualmente, a internet é de tamanha importância, que até mesmo foi declarada, pela ONU, como um direito fundamental, no sentido de que todos devem ter acesso à mesma. No entanto, no meio dualístico que é o cenário cibernético, encontra-se também a face negra da sociedade, no constante ao cometimento de crimes e delitos. Não se deve apenas aplicar o direito usual, os regramentos utilizados de forma corriqueira na “sociedade real”, o trato com os crimes eletrônicos devem ser diferenciados, uma vez que suas formas também diversas são. No entanto, como deverá ser aplicado o direito em casos eletrônicos? E mais especificamente, como fixar a competência para julgamento de referentes casos quando todas as regras usuais têm falhas? É justamente este o enfoque do presente trabalho, que vem indicar saídas efetivas para o tratamento de situações que tendem a se multiplicar pelo Judiciário brasileiro.

Cybercrimes: setting the jurisdiction in cybernetics felonies

Abstract: Today, we live in a modern society, where the law needs to be uptaded in order to became modern. The internet is such a big movement, that ir became an fundamental law, by the ONU, meaning that everyone should have acess to that. Meanwhile, in a dualistic environment, reveals the dark side of the society, meaning that it commits crimes and felonies. We should not apply the same normal law that we apply everyday with the “real life society”, the cybercrimes should be treated in a very differente way, because its forms are also diverse. But, how we should apply the law in electronic cases? And even, how we should see the jurisdiction in these cases, when all the usual rules fails? This is the focus of the present work, which comes to indicate effective ways out in order to treat that situations that became more and more frequent in the Judicial system.
