A modulação temporal dos efeitos da decisão em ADIn genérica

Resumo

É induvidosa a importância do instituto do controle judicial de constitucionalidade para a manutenção da estrutura jurídica fundada numa Constituição rígida. O controle concentrado de constitucionalidade só pode ser exercido pelo Supremo Tribunal Federal ou pelos Tribunais de Justiça, através da provocação mediante a propositura de ações especiais e diretas que veiculam as controvérsias constitucionais com o próprio objeto principal da demanda. Não existe nenhum litígio travado entre partes definidas em um caso concreto, mas apenas a defesa dos preceitos constitucionais, através da observância da compatibilidade entre um ato normativo e a Constituição Federal. Influenciado pelo sistema norte-americano, precursor da teoria da nulidade dos atos inconstitucionais, o Judiciário brasileiro atribui efeitos retroativos às decisões que declaram a inconstitucionalidade da lei impugnada no controle concentrado. No entanto, com o avento da Lei 9.868/99, o Supremo Tribunal Federal passou a ter autorização legal para manipular os efeitos da declaração de inconstitucionalidade, desde que preenchidos os requisitos formais e materiais previstos no artigo 27 da Lei 9.868/99, estabelecendo assim, que os efeitos da decisão passem a ter eficácia ex nunc, ou a partir de outro momento a ser fixado pelo STF. Contudo, não é pacífico o entendimento na doutrina pátria quanto à validade, total ou parcial, do referido artigo da Lei 9.868/99, fato evidenciado pela existência de ações diretas de inconstitucionalidade impugnando o referido dispositivo, e que ainda não tiveram o julgamento do mérito definitivamente resolvido.

 Abstract

It is unsuspicious the importance of the institute of the judicial control of constitutionality for the maintenance of the juridical structure founded in a stringent Constitution. The concentrated control of constitutionality can only be exercised by the Supreme Federal Tribunal or for the Tribunals of Justice, through the provocation by means of the purpose of special and direct actions that transmit the constitutional controversies with the own main object of the demand. Any litigation joined among parts defined in a concrete case doesn’t exist, but just the defense of the constitutional precepts, through the observance of the compatibility between a normative act and the Federal Constitution. Influenced by the North American system, precursor of the theory of the nullity of the unconstitutional acts, the Judiciary Brazilian attributes retroactive effects to the decisions that declare the unconstitutionality of the law refuted in the concentrated control. However, with I fan it of the Law 9.868/99, the Supreme Federal Tribunal started to have legal authorization to manipulate the effects of the unconstitutionality declaration, since filled the formal and material requirements foreseen in the article 27 of the law 9.868/ 99, establishing like this, that the effects of the decision start to have effectiveness of the ex nunc, or starting from other moment to be fastened by STF. However, it is not peaceful the understanding in the doctrine homeland with relationship to the validity, total or partial, of the referred article of the Law 9.868/99, fact evidenced by the existence of direct actions of unconstitutionality refuting him referred device, and that didn’t still have definitively the judgment of the merit resolved.
