A tutela jurisdicional face às manifestações populares

Resumo

Neste artigo, será objeto de análise o papel do Poder Judiciário na efetivação dos direitos fundamentais à liberdade de locomoção, reunião e manifestação, diante de uma inter-relação entre a função institucional do Poder Judiciário dentro do Estado Democrático de Direito, analisado à luz da Constituição Federal de 1988, da doutrina, da jurisprudência e dos principais aspectos que consagram o modelo de Estado Constitucional, fundado na dignidade humana e no reconhecimento constitucional do direito à liberdade. Nesse sentido, e diante dos recentes anseios sociais, com diversas manifestações públicas, nos principais centros urbanos do país, em prol de melhorias na qualidade do serviço público, especialmente nas áreas da saúde, educação e transporte, o Poder Judiciário foi provocado e se deparou com o firme compromisso de garantir a todos o direito à livre manifestação pacífica, coibindo os atos de vandalismo, sendo responsável por manter o equilíbrio entre a vontade da maioria, o Estado e os direitos fundamentais. Logo, destacamos, ao final, que a nossa Constituição é o marco de vinculação democrática primordial, onde nela se deixa aberto o espaço necessário, a fim de que a comunidade política construa o seu futuro e trace a sociedade na qual deseja viver, com o mínimo existencial e o máximo de Justiça.

A judicial protection against popular events

Abstract: In this article, will be object of analysis the paper of the Judicial Power in the effectiveness of the fundamental rights to the liberty of locomotion, meeting and manifestation, faced with an interrelation between the institutional function of the Judicial Power inside the Democratic State of Right, analyzed to the light of the Federal Constitution of 1988, of the doctrine, of the jurisprudence and of the main aspects that consecrate the model of Constitutional State, founded in the human dignity and in the constitutional recognition Of the right to the liberty. In that sense, and faced with the recent social yearnings, with diverse public manifestations, in the main urban centers of the country, in behalf of improvements in the quality of the public service, specially in the areas of the health, education and transport, the Judicial Power was provoked and had an encounter with the firm commitment of guarantee to all of the rights to the free peaceful manifestation, halting the acts of vandalism, being responsible by maintain the equilibrium between at ease Of the majority, the State and the fundamental rights. Soon, we detach, to the end, that to our Constitution is the milestone of fundamental democratic linking, where in him is left open the necessary space, in order to that the political community build the his future and draw the society in the which is going to live, with the existential minimum and the maximum one of Justice.
