Projeto legislativo de novo Código de Processo Civil e a crise da jurisdição
Resumo
O Senado Federal acenou para a necessidade premente de implementação de um novo Código de Processo Civil para afrontar os problemas da morosidade da Justiça, e da efetividade de suas decisões, sendo o Anteprojeto elaborado por uma comissão de juristas com a expressa promessa final formulada para que o novo Diploma atenda aos anseios dos jurisdicionados e dos profissionais do Direito. Nesse contexto, analisaremos a oportunidade, a conveniência, os riscos, as expectativas, os prováveis custos, os benefícios e as possíveis frustrações que poderão advir com a nova Codificação neste momento. Essa abordagem será feita em confronto com as crises da jurisdição estatal e do ensino jurídico do país. Serão apresentadas possíveis soluções e trataremos também da importância de atuação do Conselho Nacional de Justiça (CNJ), no tocante ao tema em exame.

Legislative project on the new Code of Civil procedure and the jurisdiction crisis
Abstract: The Senate acknowledges the urgent need to implement a new Code of Civil Procedure to face the problems of slowness of Justice and the effectiveness of its decisions. Indeed, the preliminary draft of the Diploma, which is currently being prepared by an advisory committee of jurists, aims at fulfilling the express purposes of not only those under the jurisdiction, but also the professionals of law. In this context, we analyse several factors involved in this circumstance, for instance, the opportunity, the convenience, risks, expectations, costs, improvements, and obstacles that may occurs due to the new coding. This approach will be carried out while confronting the crisis in both the state jurisdiction and the legal education system in the country. In this article, we attempt to put forward possible solutions and to demonstrate the importance of an active Conselho Nacional de Justiça (CNJ) – (National Justice Council), regarding the topic under discussion.
