Da mitigação do princípio da imparcialidade face à prova ilícita

Resumo

O presente artigo propõe analisar a aplicação do princípio da imparcialidade no processo penal tomando como parâmetro o contato do magistrado com as provas ilícitas. Conceitua estas e princípio da imparcialidade, questionando a suspeição e isenção do julgador para proferir um julgamento de acordo com a ordem constitucional vigente.

From the mitigation of the principle of impartiality in the face of evidence unlawfully

Abstract: This article aims at analyzing the application of the principle of impartiality in criminal proceedings taking as parameter the contact of the magistrate with illegal evidence. Conceptualizes these and the principle of impartiality and questions the suspect and waiver of the judge to issue a judgment in accordance with the current constitutional order.
