The effectiveness of the principle of independence of the judiciary in the magistracy activity by the judicial activism

Abstract: The pillars of ethics in the judiciary are the principles set forth by the Code of Ethics of the National Judiciary, among them is the Principle of Independence of Judges which aims to achieve, primarily the right decisions, and ensure the specific protection of the right material without being influenced in any way by factors other than the law itself. In seeking to give fair and effective court decisions, one must interpret the laws, before a case for a broader spectrum than that afforded by a look eminently legal, that is, a constructive interpretation that is nothing more what is now known as “judicial activism”.

Keywords: Ethics. Principle of Independence. Judicial activism.
