Controle de constitucionalidade numa abordagem sistemática
Resumo
A ideia de controle de constitucionalidade está ligada à supremacia da Constituição sobre todo o ordenamento jurídico. Está atrelada também à rigidez constitucional e proteção dos direitos fundamentais.
Nesse prisma, a existência de um escalonamento normativo é pressuposto necessário para se manter a supremacia constitucional, a fim de que o legislador infraconstitucional nela se paute e encontre os parâmetros e limitações para a elaboração legislativa, devendo ser prontamente afastadas quaisquer desvirtuações. O controle de constitucionalidade, seja por via incidental ou pela ação direta, é o mecanismo de averiguação da adequação das espécies normativas e consubstancia-se em compará-las com determinados requisitos formais e materiais, a fim de verificar-se sua compatibilidade com as normas constitucionais. Tal tema é permeado de minúcias e suas respectivas ações possuem trâmite singularizado, de modo que se busca nessa análise sistemática elaborar um panorama geral de cada uma dessas ações de constitucionalidade.

A systematic approach in control of constitutionality
Abstract: The idea of judicial review is linked to the supremacy of the Constitution on the entire legal system. It is also linked to the constitutional rigidity and protection of fundamental rights.
