Resumo

Este artigo apresenta análise do sistema clássico de divisão do Direito, contrapondo-o às atividades estatais e propondo o reposicionamento da atribuição jurisdicional. Em especial, no que pertine à função social do Poder Judiciário e o princípio da inércia da jurisdição. Apresenta, em conclusão, exemplo extraído da seara trabalhista.

The social role of the Judiciary in postmodernity

Abstract: This paper presents an analysis of the classical system of division of Law, opposing to the State activities and proposing the repositioning of jurisdiction. In particular, in respect to the social function of the Judiciary and the inertia principle of jurisdiction. It presents, in conclusion, an example extracted from the labor relations Court of Law.
